Answer: Negligence is the failure to perform in a reasonably prudent manner. Negligence occurs when a person "does not do what a reasonable and careful person would do, or does what a reasonable and careful person would not do." Medical malpractice is failure to meet the standard of care or conduct prescribed by a profession. Medical malpractice is one type of tort and can result from any mistake in medical treatment. When the medical care provided fails to meet the standard of care or conduct prescribed by a profession, then the negligence becomes malpractice.
