Knock and talk has four key elements that must be followed in order for the search to be valid. First, officers must approach the premises via open and accessible areas, like sidewalks, driveways, or the front door. Second, the nature of the encounter must be such that a person could feel free to decline the officers’ request. This means the police cannot command someone to open the door or be overly persistent in their request to search the home. Third, when summoning the party to open the door, the police may not be overly aggressive or persistent. Finally, when seeking consent to search, the police must ask question like “Can you open the door please?” or “May I have consent to search your home?” They should refrain from giving commands like “Police, open the door.” If these rules are followed, a legal “knock and talk” search may be conducted, assuming of course, that the party gives valid consent.
