In recognition of the pervasiveness and severity of bullying, every state in the United States includes specific bully-related policies into their public school laws. Anti-bullying laws do not criminalize bullying itself but stipulate that school districts take action to prevent or intervene when bullying occurs. School boards are charged with establishing anti-bullying policies. Most developmental researchers agree that a model bullying law should include, at minimum, the following: a clear definition of bullying, explicit articulation of a bullying prohibition, implementation of prevention and treatment programs, and acknowledgment of the association between bullying and public health risks. State anti-bullying laws vary dramatically but, as a whole, are associated with a 7-13% reduction in school violence and in reports of bullying.
The Safe Schools Improvement Act, proposed in 2013 and reintroduced to Congress in 2017, is legislation that would require states to collect and report information on the incidence of bullying and harassment. It would also permit schools to use federal grants to prevent and respond to incidents of bullying and harassment, require schools to provide annual reports of bullying prevalence and policies, and establish grievance procedures for students and parents to register complaints regarding such conduct. Although not yet passed by Congress, the Safe Schools Improvement Act sets an important precedent by acknowledging the relevance of peer victimization to children's everyday lives.
