The restoration of sanity was an issue in Ford v. Wainwright (1986). Career criminal Alvin Ford had been sentenced to death for the cold-blooded execution of a wounded police officer responding to a robbery being committed by Ford. There were no competency issues raised during Ford’s trail, but he later claimed to have descended into insanity while on death row. Although prosecutors viewed Ford’s claim of insanity to be a convenient ploy used just as his appeals were running out, three of four psychiatrists who examined him concluded that he was psychotic. In Ford, the U.S. Supreme Court held that the Eighth Amendment prohibits execution of the insane. The Court also ruled that if Ford would still have to prove that he was as mentally ill (insanity is an affirmative defense in which the burden of proof lies with the defendant). Ford died in 1991 of natural causes, 28 years after his crime.
