State the standard of the legal construct standard of care


Many of the health care questions regarding which allocation system to select revolve around legal issues involving standard of care requirements. Essentially what the law requires is that health care providers conform to a specific standard of care. A provider, such as a nurse who assumes the care of a patient, assumes a duty to provide that care with the degree of skill and knowledge ordinarily possessed and exercised by other nurses. Whereas the health care provider is expected to act with professional judgment, this judgment must remain within the bounds of accepted practice for that specialty group.
