The requirements for a valid marriage are set by state law. In most states, marriage creates a legal relationship between a man and a woman. Other states also allow same sex marriages or allow homosexual couples to enter into a civil union, which gives them the same rights as married individuals within the state. Requirements for a valid marriage may include that the party be of a certain age or meet certain health standards. Consanguinity restrictions limit marriage of parties who are related by blood and affinity restrictions limit marriage between stepparents and stepchildren or in-laws. No state allows a marriage to more than one person at the same time.

Ceremonial marriages are required in most states. In 13 states and the District of Columbia, ceremonial marriages are not required, and a common law marriage is recognized. In a common law marriage, parties must have the capacity and intent to enter into a marriage, and hold themselves out to others as being husband and wife.
