What will be an ideal response?


On the basis of the Sixth Amendment to the US Constitution, for many years, the federal court system provided counsel to the indigent unless the defendant waived this right. In the case of Gideon v. Wainwright, the US Supreme Court took the first major step on the issue of right to counsel by holding that state courts must provide counsel to indigent defendants in felony prosecutions. In the case of Argersinger v. Hamlin, the court extended the obligation to provide counsel to all criminal cases where the penalty includes imprisonment.
