Involuntary manslaughter is a criminal homicide in which an unintentional killing results from a reckless act. In such cases, the defendant is charged with consciously disregarding a substantial risk that he or she should know would put others in danger of losing their lives. The most obvious example of this is driving under the influence of alcohol or some other drug. Negligent manslaughter is an unintentional homicide as a result of a negligent act that carries a substantial risk of death to others. Note that involuntary manslaughter is charged when defendants do something they should not have (i.e., drive drunk), and negligent homicide is charged when they neglect to do something they should have.
