What does the term "automobile" mean in the automobile search context?
What will be an ideal response?
The Supreme Court was confronted with this question in the case of California v. Carney (471 U.S. 386 [1985]). Unfortunately, it refused to define explicitly the types of automobiles covered by the automobile exception and held that the test of whether a vehicle serves a transportation or residence function requires looking at the setting in which the vehicle is located. If the setting "objectively indicates that the vehicle is being used for transportation", then the automobile exception applies.
