There's wide agreement (but a surprising lack of precise numbers) that most terrorism cases involve providing "material support" to terrorists or terrorist organizations. A number of lower courts have decided challenges to the constitutionality of the "material support" sections—namely, the First Amendment rights of free speech and assembly and the Fifth and Fourteenth Amendments' denial of due process (vagueness). These courts have reached conflicting results. Students should identify the issues and make an argument for or against void-for-vagueness or First Amendment issues.
