Describe the difference between simple robbery and armed robbery, listing what elements the prosecutor must prove to get a conviction for each. Additionally, what elements must a prosecutor prove to get a longer sentence?
What will be an ideal response?
The essential elements of robbery are a taking and carrying away of the property of another, the intent to steal that property, property taken from the person or in the presence of a person, and the use of force or threat of the use of imminent force. Simple robbery is carried out without a weapon, armed robbery with a weapon. In armed robbery, sentences are longer for robberies using firearms, longer still for robberies where the defendants brandished a firearm, and longer still if the firearm is discharged during the robbery.
