Examples include: Should the expert provide an opinion about whether the defendant was indeed insane (and therefore not responsible) at the time of his crime? Should the expert recommend which parent should be awarded custody? Should the expert declare that a defendant is competent to be executed? Should the expert recommend that a juvenile’s case be transferred to criminal court? Ultimate issue testimony is highly subject to error. Experts may misunderstand the law or have biases that influence their conclusions. Undue influence of the expert is also a concern. On the other hand, many experts are becoming more sophisticated about possible sources of error. Improved training has resulted in higher quality evaluations. The APA has not taken a stand on ultimate issue testimony.
