The Sixth Amendment applies only in criminal cases, and is available only to criminal defendants; neither the prosecution in criminal cases nor parties to civil cases may invoke the Sixth Amendment. Examples would include Regularly Kept Records Exception, Statement-Against-Penal-Interest Exception, the Dying Declaration Exception and the Existing Mental, Emotional and Physical Condition Exception.
