Interestingly, there is no constitutional right to bail. The Eighth Amendment only provides that "excessive bail shall not be required." This means that bail should be an amount that is not unreasonable but that will guarantee the defendant's appearance at trial. In many jurisdictions, judges follow bail schedules, except in cases of serious or unusual offenses.
