Trial courts bear the responsibility of determining the admissibility of photographs as evidence in court. Such determinations have been based on several legal precedents:
Materiality:
A material photograph is one that relates to and makes a substantive contribution to the specific case in question.
A relevant photograph also applies to the matter in question and is used to support testimony.
Prejudicial images:
Any photograph or image admitted must not prejudice, or appeal unfairly, to the emotions of the jury.
Distorted photos:
Photographs must be kept free of distortion. Three types of distortion have generally been common in crime-scene photographs: incorrect point of view, perspective, and misrepresentation of tone or color.
