Define the efforts that the federal government has made to protect from pornographic material on the internet. Have the government's efforts been successful? Why or why not?
What will be an ideal response?
• Congress first passed the Communication Decency Act of 1996, which regulated the internet. This effort was universally opposed and the United States Supreme Court ruled it unconstitutional because it violated the free speech guaranteed by the 1st Amendment. Next, Congress passed The Child Online Protection Act (COPA), implementation of which has been stalled in the federal courts for years about the application of contemporary community standards.
• Technological limitations may make it extremely difficult to regulate pornographic material on the internet, although there is some hope technological advances will allow for such regulation without violating constitutional guarantees.
