The individual alleging libel must be clearly identifiable in the potentially libelous material. The information must be sent to someone other than the person who claims to be libeled. In the United States, the law dictates that the plaintiff must prove the statement is false in order to win a libel suit. The statements must serve to damage the plaintiff’s reputation. Although the standards of fault vary based on a number of variables, private individuals usually must show that the defendant acted in a negligent manner. In the case of public figures, the standard is much higher and usually referred to as actual malice.
