• Forgery is the making of a false instrument with intent to defraud or injure another. Uttering is the passing or attempted passing of a forged document knowing it to be false, with the intent to defraud.
• Example: Jack forges a check by stealing a blank check from ABC Corporation. He makes the check payable to Sam Jones in the amount of $6,118.27 . Sam, whose real name is Harold A., knowing the check to be false, takes the check to XYZ Bank where he previously opened an account in the name of Sam Jones with $50.00 cash. He had a false I.D. in the name of Sam Jones. He deposits the check, then goes to a drive-through window at another branch of the bank and withdraws $6,000.00 . He gives half to Jack and keeps the rest of the money. Jack is guilty of forgery. Harold, probably among a number of violations, is guilty of uttering.
