A requirement to disclose exculpatory evidence that would otherwise not be offered by the prosecution at trial would seem to disadvantage the prosecution. Meanwhile, the defense is not required to disclose evidence that it will not use at trial. The prosecution also has a constitutional duty to preserve evidence, but the defense does not. These two methods are called nonreciprocal discovery.
