Explain what a codicil is and under what circumstances they may be used.
What will be an ideal response?
A codicil is an addition or supplement to a will or certain sections of the will. Codicils require the same formalities as a will. In that, it must include the testator’s intent, show the capacity of the testator, have the testator’s signature, and be signed by witnesses. With today’s modern use of computers it is often just as easy to write a new will instead of creating a codicil which may become lost or not meet statutory requirements.
