On the day of the proposed purchase, Owen told John he would get the money and the agents discovered John in the car with the kilogram on his lap. At John's drug trial, he raised the defense of entrapment. Will he be successful?
John was a small time drug dealer. One of his customers, Owen, was caught by federal drug agents. To negotiate for a less sever charge and consequently a less severe sentence, Owen decided to cooperate with the government and continue to make controlled buys of drugs from John. As the agents set up audio and video surveillance of John, Owen continued to purchase small quantities of cocaine, but began to insist that John procure at least one kilogram of cocaine for Owen to buy. It took repeated requests and many months, but John finally secured the kilogram for Owen to buy.
What will be an ideal response?
ANSWER: Answers may vary: John was predisposed to selling drugs and the fact that he was enticed to procure a lager quantity than usual will not suffice for a successful entrapment defense.
