Distinguish between voluntary and presumptive sentencing guidelines

A basic response will note that with voluntary guidelines possible sentences are suggested but judges are not required to follow those suggestions. With presumptive guidelines judges are required to issue a sentence that falls in a range established for a particular crime. If judges deviate from the presumed guideline, they may be required to provide a written explanation for the deviation. A more complete response may also note that the presumptive model has been endorsed by the American Bar Association and research suggests it may be more effective than voluntary guidelines at eliminating racial and ethnic disparities.
