Discuss the positives and negatives of a written statement verses a recorded statements
What will be an ideal response?
Answers will vary. Positively, the written and recorded statements are in the offenders own words and details of extenuating circumstances or explanations can be offered. The suspect may not want to sign the written statement. Negatively, the written statement is based on the offenders ability to write, and may lack details. The officer may write the statement for the offender, but must write it strictly as how it was said. Recorded statements may have a positive effect if the suspect has difficulty reading and writing. Negatively, the offender may become nervous having his statement recorded. Video recording also allows others to see nonverbal communication. Video recording also allows for observers to verify that no coercive behavior was included and that the statement was given voluntarily.
