Formal charges are normally initiated by a peace officer filing a sworn complaint. Depending on the county and the severity of the charge, the officer may need to receive approval from the prosecutor as to which particular charge to file. If a felony, the matter will later be presented to the grand jury which will choose whether or not to indict the offender and on which charge. If a misdemeanor, the prosecutor will file an information as the formal charging instrument.
