Discuss intentional misrepresentation


Intentional misrepresentation occurs when a seller or lessor either misrepresents the quality of a product or conceals a defect in it. For example, a cleaning product might be advertised as safe to use in confined areas, but some users pass out from the fumes. In this case, a buyer or lessee who is injured can sue the seller for intentional misrepresentation or fraud. Advertising, salespersons' comments, invoices, and shipping labels are all forms of representation. Most software manufacturers use limited warranties and disclaimers to avoid any claim of misrepresentation.
