Performing acts that would ordinarily be performed by an attorney can constitute UPL. The activities that should be identified are: giving legal advice, preparing documents and pleadings for a client without attorney review or supervision, accepting a client, setting a fee, negotiating with an opposing side, appearing in court, setting up an office to provide legal services, failing to identify oneself as a “non-attorney.” Avoiding thee acts would protect a paralegal from committing UPL.
