Under a bailment, physical possession of goods is temporarily transferred to another party. The bailment may be gratuitous or for a fee (a bailment for hire.) The bailee has the right to take possession of the goods; the bailor has the right to have the goods returned. A bailment may be for the benefit of the bailor, the owner of the property; for the benefit of the bailee, to whom possession is transferred; or for the parties’ mutual benefit. When a bailment is for the benefit of the bailee, a duty of extraordinary care is owed. In the common mutual benefit bailment, an ordinary degree of care is owed. If the bailor is the only party to benefit from the arrangement, only a slight degree of care is owed by the bailee. A gratuitous bailment for the sole benefit of the bailor arises when one finds lost property.
