Although most jurisdictions allow judges to depart from the guidelines and impose a more or less severe sentence than the guidelines require, the circumstances under which departures are justified are narrowly defined, and judges must provide a written justification for the departure. In most jurisdictions, judges are allowed to depart if there are specified aggravating or mitigating circumstances.
