Who or what determines that an organization is an FTO? Analyze and explain their rationale for the decision they make.
1) It must be foreign, 2) it must engage in terrorist activity as defined in Section 212 (a)(3)(B) of the Immigration and Nationality Act 117, and 3) the organization's activities must threaten the security of U.S. nationals or the national security (national defense, foreign relations, or economic interests) of the United States. The Immigration and Nationality Act 115 and the Intelligence Reform and Terrorism Prevention Act of 2004 116 provide the U.S. Department of State with the authority to designate any group outside the United States as an FTO.
