The Family Medical Leave Act (FMLA) of 1993 requires employers with more than 50 employees to provide up to 12 weeks of unpaid sick leave per year for the birth or adoption of a child or to care for a sick child, parent, or spouse, excluding temporary and part-time workers. It covers both male and female workers. With the exemptions, over 40% of private sector employees are not eligible for FMLA leave, with the probability of being eligible increasing with level of education.
