Explain the Daubert Standard.

What will be an ideal response?


The standard was developed to assist in determining how new technologies can be introduced in court in front of a judge and jury. For a witness to be able to testify as an expert, he or she must be trained in the collection and preservation of scientific evidence and must use appropriate and reliable technology. The Daubert Standard is articulated in rule 702 of the Federal Rules of Evidence, which states:
If scientific, technical, or other specialized knowledge will assist the trier of fact to understand the evidence or to determine a fact in issue, a witness qualified as an expert by knowledge, skill, or experience, training, or education may testify thereto in the form of an opinion or otherwise if: (1) the testimony is based upon sufficient facts or data, (2) the testimony is the product of reliable principles and methods, and (3) the witness has applied the principles and methods reliable to the facts of the case
