A short sale is the sale of property for a price that is “short” or less than the full amount owed on the property.  A short sale addendum (1) explains to the borrower/owner that any sale of the property is contingent on the approval of the lender and other lienholders, and that the broker cannot provide any guarantees of this approval, (2) explains that the lender may require modification of various terms prior to approval for approval to be granted, (3) explains that lender approval may not always extinguish all obligations of the borrower/owner to the lender, (4) suggests that the borrower/owner solicit advice from attorneys, accountants and other professionals regarding the legal, tax and credit consequences of the short sale, (5) requires the borrower/owner to provide authorization for the lender to provide requisite information to the broker, (6) requires the borrower/owner to provide all requisite documentation required for the short sale package, and (7) provides authorization for the broker to market the property as a short sale and indicate in the MLS listing that the sale of the property and the commission to be paid to the broker and cooperating brokers is subject to the approval of lender and may be modified.
