The advantages of the workers’ compensation system is that it offers a relatively dependable compensation to a qualifying worker, although probably less than what the worker might have received had he or she filed a personal injury claim. The worker surrenders the right to file such a claim in exchange for this compensation. The advantage to the employer is obvious: no personal injury suits, and thus, no possibility of a massive jury verdict. On the other hand, the employer must fund the workers’ compensation system, either by purchasing private insurance or contributing to a state-based system.
