What is the principle of comity? What conditions must usually exist for the principle to be applied?


Under the principle of comity, a court will enforce another country's judgments under certain conditions. Usually, three conditions must be met: (1) reciprocity must be extended between the countries (i.e., the countries have agreed to mutually honor each other's court decisions, usually by way of a treaty); (2) proper notice is given to the defendant; and (3) the foreign court's judgment does not violate domestic statutes or treaty obligations. U.S. courts, however, generally do not require reciprocity in order to honor foreign judgments.
