How does the general conflicts of interest rule work? What determines if the lawyer cannot seek the client’s consent to continue the representation when a conflict is discovered?
What will be an ideal response?
A lawyer may not represent a client if the representation of that client will be directly adverse
to another client, unless the lawyer believes the representation will not adversely affect the
lawyer’s relationship with the other client, and both clients give their consent after being
consulted.
A lawyer is not to seek the consent of each client to continue the representation if the conflict
between the two clients is “directly adverse” or if the representation of one of the clients will
be “materially limited” by the interests of the other client.
