The element of duty is the most important. If the wrong doing has no duty toward the victim, then he or she is not liable in most cases. For example in an automobile accident where one party is injured, to recover the injured party must establish that the negligent person had a duty to drive safely. In law generally implies that if you drive on a highway or other public road you have a duty to drive safely and if you breech that duty you are liable for damages.
