How has the Supreme Court left policymakers in a somewhat ambiguous position when it comes to the property tax and equalization of resources in public schools?
What will be an ideal response?
The Court gave seemingly contradictory rulings in Serrano v. Priest and San Antonio School District v. Rodriguez. In Serrano, the Court said that the great disparity in educational funding between richer and poorer school districts in Los Angeles has violated provisions of both the state constitution and the U.S. Constitution, constituting a denial of equal protection for the residents of poorer districts. The Court did not offer a remedy for the disparity. In San Antonio School District, the Court ruled that the differences between two Texas school districts were not so great as to violate the Equal Protection Clause. However, the Court did not say how much of a difference would constitute a violation. The decisions left open the constitutionality of continued disparities among school districts, but the problems that local districts face in attempting to provide for decent education from a low property tax base remain tangible.
