An interest in a joint tenancy. Upon the death of one tenant, his interest in property will pass automatically to the surviving joint tenant or tenants. A will is not required to pass property that is held in this manner because the property passes by operation of law (a non-probate asset). When there is only one tenant remaining, that tenant will own the property in fee simple and must either leave the property by will, let it pass by intestacy or create a new joint tenancy with right of survivorship.
