Psychologists working in the school should be familiar with FERPA, which regulates the education records of students. Under FERPA, parents and students have the right to access educational records. The students’ mental health records must be maintained separate from the education record to avoid unintended violation of the student’s privacy. Once they are included, then HIPAA privacy no longer applies.
