The four different tests of insanity include the M’Naghten rule, the irresistible impulse test, the Durham
rule, and the substantial capacity test. The M’Naghten rule is also known as the right-wrong test,
meaning that the M’Naghten standard for insanity is realized if a defendant did not know either what he
or she was doing or know that it was wrong. The irresistible impulse test is defined as the inability to
control one’s conduct, even though one is aware that what they are doing is wrong. The Durham rule or
product test, is met when the act was the product of the defendant’s mental illness. It goes beyond the
right-wrong test to include mental disease or defects. Almost all jurisdictions have abandoned the
Durham test for being too broad. The substantial capacity test is defined as when the defendant lacks
substantial capacity to appreciate the wrongfulness of his or her conduct or the ability to control it. It is a
blend of the M’Naghten and irresistible impulse tests.
