Generally, the prosecutor and defense attorney will have a defendant enter into a plea agreement that sentences the defendant to the going rate--that is, the typical sentence for the crime charged. If the prosecution believes it has a case with weak evidence, it is likely to push for a plea agreement in which the defendant receives a better bargain than the going rate, yet the prosecution still obtains a conviction. On the other hand, if the prosecution has an airtight case, or a "slam dunk" against a defendant, it may be unwilling to offer any concessions in exchange for a guilty plea.
