Miranda v. Arizona, which requires that the police must inform a suspect of his constitutional rights against self-incrimination and his right to an attorney. These rights include that a suspect does not have to speak to the police if asked any questions about a crime and if he decides to speak he has the right to have an attorney present. Also, the suspect is warned that anything he says can and will be used against him in a court of law. Finally, Miranda requires that the police inform the suspect that if he cannot afford an attorney then one would be appointed prior to questioning. The Miranda case falls under the Fifth Amendment, which required the police to inform a suspect of his constitutional rights.
