The criminal protective order is issued in conjunction with a criminal case, by the judge at the time of trial. It places limitations on the defendant, preventing harassment or assault.
A civil restraining order is sought by the victim in civil court. It begins with an ex parte Temporary Restraining Order, and can be converted, with a hearing, into permanent stay away orders, or no contact orders.
