To have standing and challenge the manner in which police obtained evidence from a crime scene, a defendant must show that he or she had a legitimate expectation of privacy in the crime scene. For example, a burglar who illegally entered a home has no legitimate expectation or right of privacy in the home and therefore no standing to challenge evidence against him that police obtained from the home. Any examples should reflect the student's understanding of the expectation of privacy and provide correct examples based thereon.
