Charges brought against a DNA profile may languish for years until the person fitting the profile is found. By then, the technician who originally processed the DNA may no longer be employed, may be dead, disabled, or missing. Labs will have to re-examine DNA evidence to certify that it matches the suspect once he has been located. The technician performing that last test will have to testify to satisfy the confrontation clause. Defense attorneys may attempt to impeach this testimony by inferring the new technician just ‘signed off’ on the work of the old technician. Technicians in this situation should be prepared to offer evidence they processed the DNA themselves.
