Define selective incorporation and discuss its historical development.
What will be an ideal response?
Selective incorporation is the process through which the Supreme Court has preferred to interpret the application of the Bill of Rights protections to the states. Rather than apply all the protections contained in the Bill of Rights simultaneously, the Court has ruled on each individually in a process that began only in 1925 with Gitlow v. New York. Several liberties still have not been applied to the states.
