Police supervisors may be held liable under Section 1983 for negligence supervision and direction of officers, which involves a breach of a duty to provide effective systems for the evaluation, control and monitoring of police employees’ performance. Examples may include the failure to provide written and verbal directives, to develop adequate policies and guidelines, or to articulate clearly to employees how duties are to be performed. A supervisor’s direction to an officer to engage in an illegal activity or the supervisor’s approval of an officer’s illegal activity may also result in supervisor liability. Police supervisors have also been found liable for injuries arising out of an official policy or unofficial custom of their department, such as injurious behavior that is verbally supported by a supervisor.

In addition to negligent supervision, police supervisors are also liable under Section 1983 for negligent hiring and training of officers. They may also be sued by officers who believe they were improperly disciplined or terminated, and by unsuccessful job applicants who claim that the administrator’s tests were not job related, included inherent bias, or were not properly administered or graded.
