Human trafficking:
• Must contain an element of force, fraud, or coercion (actual, perceived, or implied), unless the victim is under 18 years of age and is involved in commercial sex acts.
• Forced labor and/or exploitation.
• Persons trafficked are victims.
• Victims are enslaved, are subjected to limited movement or isolation, or have had documents confiscated.
• Need not involve the actual movement of the victim.
• May or may not cross an international border.
• Victim must be involved in labor/services or commercial sex acts (that is, must be "working").
Human smuggling:
• The person being smuggled is generally cooperating.
• No forced labor or other exploitation.
• Persons smuggled are violating the law. They are not victims.
• Smuggled individuals are free to leave, change jobs, etc.
• Facilitates the illegal entry of people from one country into another.
• Always crosses an international border.
• The person must only be in the country or attempting to enter illegally.
