What risks are involved when a lawyer simultaneously represents two or more clients on the same side of litigation?
What will be an ideal response?
It is always possible that even though two or more clients sharing the same lawyer start out
as having aligned interests, those interests can diverge during litigation. One client might
want to settle whereas the other does not, or, worse, one client might eventually believe that
the other client is to blame for the litigation. This type of risk is much more dangerous with
two or more clients in a criminal case.
