In states that have adopted a finding of “guilty but mentally ill,” a jury may find that while the defendant was not legally insane at the time of the crime, the defendant was mentally ill. With such a finding, the defendant is sentenced to a standard sentence of criminal confinement but receives treatment while incarcerated. “Guilty but mentally ill” is an alternative to a finding of legal insanity.
